In applications for payment of benefits (vacation pay) (Appendix No. 1 to the order of the Social Insurance Fund dated September 17, 2012 No. 335), employees sign in the column “Signature of the applicant / his authorized representative” with a ballpoint pen in ink of blue color. When filling out an application for payment of benefits (vacation pay), approved by Order of the Federal Social Insurance Fund of the Russian Federation dated September 17, 2012 N 335, the following requirements apply.

Entries are made in Russian in block letters and black ink. You can use gel, capillary, or fountain pens. The use of printing devices is allowed. Entries should not go beyond the boundaries of the cells provided for making the corresponding entries.

Decree of the Government of the Russian Federation dated April 21, 2011 N 294 does not provide for special liability in a situation where signatures are made with a blue ballpoint pen.

Meanwhile, this fact may be the basis for increasing the period for consideration by the Social Insurance Fund of an application for payment of benefits (clause 7 of Regulation 294).

So, if the FSS considers that the information is presented in an improper form, it will send the policyholder a notice of the submission of documents. And this, in turn, may affect the date of payment of benefits.

Situation: How to pay benefits in the regions that are participating in the pilot project of the Federal Social Insurance Fund of Russia according to a special procedure for the assignment and payment of social benefits

The pilot project provides that all types of social benefits, including temporary disability benefits, benefits for registration in the early stages of pregnancy, benefits for the birth of a child, maternity benefits, child care benefits, etc., units The Russian Social Insurance Fund pays directly to insured persons, that is, employees, bypassing employers. The payment procedure is established by Decree of the Government of the Russian Federation dated April 21, 2011 No. 294.

The following are involved in the implementation of the pilot project:

 from January 1, 2012 to December 31, 2019 – Karachay-Cherkess Republic and Nizhny Novgorod region;

 from July 1, 2012 to December 31, 2019 – Astrakhan, Kurgan, Novgorod, Novosibirsk, Tambov regions and Khabarovsk region;

 from July 1, 2018 to December 31, 2019 – the Republic of Sakha (Yakutia), Trans-Baikal Territory, Vladimir, Volgograd, Voronezh, Ivanovo, Kemerovo, Kirov, Kostroma, Kursk, Ryazan, Smolensk, Tver regions;

 from July 1 to December 31, 2019 - the Republic of Dagestan, the Republic of Ingushetia, the Republic of Karelia, the Komi Republic, the Republic of North Ossetia - Alania, the Republic of Khakassia, the Kabardino-Balkarian Republic, the Udmurt Republic, the Chechen Republic, the Chuvash Republic, Arkhangelsk, Tula, Yaroslavl areas.

This follows from paragraph 2 of Decree of the Government of the Russian Federation of April 21, 2011 No. 294 and paragraph 3 of the changes approved by Decree of the Government of the Russian Federation of December 19, 2015 No. 1389.

In order for an employee to receive the sick leave benefits due to him, he must first submit all the necessary documents to his employer.

If the employee’s disability is not related to an industrial accident, he submits to the organization:

 application for payment of benefits in the form approved by order of the Federal Social Insurance Fund of Russia dated September 17, 2012 No. 335;

 certificate of incapacity for work;

 certificates of earnings from previous places of work for billing period, if they have not been submitted previously.

This procedure is established in paragraph 2 of the Regulations, approved by Decree of the Government of the Russian Federation of April 21, 2011 No. 294.

Submit the documents received from the employee within five calendar days to the FSS office of Russia at your place of registration. Attach a list of the documents being transferred. The inventory form was approved by order of the Federal Social Insurance Fund of Russia dated September 17, 2012 No. 335.

The method of transferring a set of documents depends on the average number of employees of the organization. So, if it does not exceed 25 people, documents are submitted on paper. When the average headcount is 26 people or more, electronic communication channels must be used. In this case, the information necessary for calculating benefits is submitted in the form of an electronic register. The form of the register and the procedure for filling it out were approved by order of the FSS of Russia dated June 15, 2012 No. 223.

Having received the documents, the FSS branch of Russia reviews them within 10 calendar days and makes a decision on payment of benefits or refusal of it. If the decision is positive, the money is transferred to the employee using the details that he indicated in his application. This transfer procedure applies to benefits for temporary disability, pregnancy and childbirth, at the birth of a child, for registration in early pregnancy, as well as the initial payment of child care benefits. Subsequent payments of child care benefits are made by the territorial body of the Federal Social Insurance Fund of Russia from the 1st to the 15th of the month following the month for which such benefits are paid.

This procedure is established by paragraphs 3, 4, 8, 9 of the Regulations approved by Decree of the Government of the Russian Federation of April 21, 2011 No. 294.

Please note: sickness benefits are paid by the fund in accordance with the generally established procedure. That is, if the employee himself falls ill for reasons not related to an accident at work, the fund accrues benefits starting from the fourth day of illness. The employer pays for the first three days of incapacity at his own expense. This is explained in paragraph 6 of the Regulations, approved by Decree of the Government of the Russian Federation of April 21, 2011 No. 294.
