How to organize a medical examination?

The need for workers to undergo medical examinations, and for employers to organize them, is spelled out in Art. 212, 213 Labor Code. And as we have already said, medical examinations are regulated by Order 302n.

It lists in detail:

  • production factors for which workers need to undergo a medical examination;
  • jobs for which they also need to undergo a medical examination.

For each item in the list of factors or works, the following is given:

  • frequency of inspections for this factor or work;
  • a list of specialists who must assess the worker’s health status;
  • list of laboratory and functional tests (blood test, ultrasound, ECG, etc.);
  • additional requirements or contraindications (for example, the absence of a hand may be an obstacle to working as a security guard, an employee of the Ministry of Emergency Situations, a turner, a driver, etc.).

Usually this information is enough to compile a list of professions to undergo a medical examination at a specific enterprise. If it is difficult for an occupational safety engineer or other authorized person to do this on their own, employees of the clinic where the medical examination is planned to take place, or employees of sanitary and epidemiological authorities will always come to the rescue.

Based on this list, an order is drawn up annually to undergo a medical examination at the enterprise, a sample of which can be asked from the labor inspector (a sample order is posted in this article with the ability to download it).

Typically, the list of doctors and tests for a specific place of work is the same for the preliminary medical examination upon hiring and periodic medical examinations. If working conditions have changed or the employee has acquired an additional profession, then the number of doctors and tests required to undergo a medical examination will increase.

The need to undergo a medical examination upon hiring and during work

Workers need to undergo a medical examination in order to:

  • preserve your health, and in some cases, your life;
  • women - to bear and give birth to healthy children;
  • obtain permission to perform work;
  • newly hired persons - find out whether their health condition will allow them to perform the desired job.

Employers need to organize a medical examination in order to:

  • prevent accidents and diseases related to working conditions of workers;
  • ensure maximum production efficiency (no need to look for replacements for constantly ill workers, pay sick leave, train new workers hired to replace sick workers);
  • ensure sanitary and epidemiological safety in their organizations (relevant for hospitals, pharmacies, kindergartens, schools, canteens, cafes, restaurants, hairdressers, beauty salons, hotels, sports complexes and other public service institutions);
  • avoid penalties.

What medical examinations do workers undergo?

Medical examinations can be preliminary, periodic, preventive, unscheduled, pre-shift and post-shift.

Pre-employment medical examination All workers who have hazardous working conditions, have a risk of contracting occupational diseases, as well as persons specified in Article 213 of the Labor Code of the Russian Federation (trade, education, food industry, etc.) must undergo the test.

Repeated medical examinations Only workers who are included in the current department’s list of professions are required to undergo a medical examination. In different organizations, medical examinations for representatives of the same profession differ. This happens because, in addition to the name of the profession or position, when sending for a medical examination, the harmful and dangerous factors that affect the worker and the categories of work that he performs are taken into account. For example, in one building materials warehouse, the night cleaner simply washes the floor, so every year she only undergoes a fluorogram and a gynecologist. And in another, she also washes high-lying windows and chandeliers, so she still needs to see a neurologist, ophthalmologist and surgeon. If she does not use a rag and a mop to clean the floor, but a special machine, then the research and inspections necessary for admission to servicing machines and mechanisms are added to the list.

Please note: workers under 21 years of age must undergo a medical examination annually, regardless of the category of work they perform.

The list of works, as well as harmful and dangerous production factors, in the presence of which a mandatory preliminary medical examination is carried out upon hiring and periodic medical examinations (examinations) are specified in Appendices 1 and 2 of Order 302n “On Medical Examinations”.

There are also unscheduled medical examinations that are carried out upon request:

  • employer. The employer has the right to send the worker for an unscheduled medical examination if he has been ill for a long time or with a certain disease (for example, a disease of the cardiovascular system has manifested itself for the first time), or there are suspicions that his health condition does not allow him to perform his work duties;
  • worker. He has the right to demand that he be sent to undergo an unscheduled medical examination if he believes that his health condition has worsened due to the influence of any production factors;
  • medical institutions. Based on the results of the next medical examination, doctors may recommend undergoing the next examination earlier, for example, not after 1 year, but after 6 months.

The employer pays for all medical examinations of its employees, even potential ones. If a worker (most often a job applicant) paid for the medical examination himself, the money spent must be reimbursed.

Who is responsible for medical examinations?

In general, the employer is responsible for organizing and conducting medical examinations. Therefore, from among his employees he selects those responsible for:

  • compiling a list of professions to undergo a medical examination. Typically these are OT employees;
  • preparation and issuance of an order about passing a medical examination at the enterprise, a sample of which is kept by the clerk, the health care service or other persons involved in the process;
  • organizing the medical examination itself– preparing documentation for the hospital, sending employees for a medical examination, monitoring its completion;
  • prohibition from work of persons who have not passed the examination. Most often these are the immediate supervisors of the work (site managers, foremen).

The day or days on which workers undergo a medical examination are paid “on average”. If a worker refuses to undergo a medical examination, he is not allowed to work, and the days during which he did not work for this reason are not paid.

How to organize periodic medical examinations at your enterprise?

To organize a medical examination, you need:

  1. Study the provisions of Order 302 on passing medical examinations.
  2. Conclude an agreement with a medical institution for conducting medical examinations, agree with it on the start date for medical examinations of employees of your organization.
  3. Based on the provisions of Order 302, compile a list of professions of the organization’s workers who must undergo a medical examination upon hiring and for periodic medical examinations. When compiling a list, you also need to take into account vacant positions.
  4. Approve this list with the sanitary and epidemiological inspection body that controls your organization.
  5. Calculate the number of workers in the professions included in the list. Make a list of their names indicating their full name, profession (including part-time work), age, gender, harmful and dangerous factors and special work, the name of the structural unit and approve it with the employer.
  6. Send this approved list to the medical institution no later than 2 months before the date appointed in paragraph 2.
  7. Within 10 days after sending the list, receive from the medical institution a calendar plan for the medical examination of its employees. It must be drawn up at least 2 weeks before the start of the medical examination. The employer agrees on this calendar plan, and the medical institution approves it.
  8. Organize the arrival of the organization’s employees at the medical facility on the days allocated for their medical examination.
  9. Pick up medical reports, the final act, and other documentation that the medical institution will provide, for example, certificates of work performed under the contract.
  10. Organize control over the implementation of recommendations issued by the medical institution for each employee, if this concerns the employer. For example, if a loader of raw materials and materials is recommended to be transferred to another job due to unsatisfactory lung condition, the employer should take care of this. And if he is recommended to consult a nephrologist due to congenital characteristics of the body, then he should do this himself.
  11. Ensure that employees who have not passed a medical examination are not allowed to perform work.

When drawing up an estimate under a contract, keep in mind that the cost of examining a specific employee is determined as the sum of examinations for “his” factors and types of work that are included in the list. Therefore, the cost of examining a man and a woman of the same profession (for example, conveyor operators) will differ due to different examinations.

Since the personnel composition of the organization is constantly changing, it is convenient to conduct medical examinations under 2 contracts concluded with the hospital: one for periodic medical examinations, the other for preliminary medical examinations when hiring. Under a “periodic” agreement, payment can be made as a one-time payment; under a “preliminary” agreement, payment can be made monthly, depending on the number of people examined by order of the enterprise.

How to organize a medical examination when applying for a job?

To organize such a medical examination, you need:

  • conclude an appropriate agreement with a medical institution;
  • issue the candidate for employment with a referral approved by the employer in accordance with Order 302 no on undergoing medical examinations;
  • notify the candidate that at the medical institution he will need to present this referral, a passport, if necessary, the results of a psychocertification, a health passport, if he has one;
  • obtain from him a conclusion from a medical commission based on the results of the medical examination;
  • draw up accounting documents for the medical examination - certificate of completion of work, etc.

Who needs it?

For example, a person will be asked for a Form 302 medical certificate if:

  • the employee will work with welding equipment;
  • labor is planned in the mines;
  • the place of work is a source of increased noise or gas pollution;
  • people are sent to work in the North.

Typically, applicants and students need the certificate being studied during an internship or directly upon enrollment in a university. It won’t be difficult to arrange it.

Where can I get it?

For admission to educational institutions and for employment, it is requested from various authorities. Citizens themselves decide where to turn for help.

To date, the following authorities are known to issue the forms being studied:

  • clinics;
  • hospitals with outpatient departments;
  • private multidisciplinary centers and laboratories.

Accordingly, citizens can apply for a sample certificate 302n both at a free clinic and at a private medical center. Each technique has its pros and cons. More on them later.

Specialists for document

First, let's try to find out which doctors will need to be visited to complete the task. Medical certificate 302n is issued only after passing a commission of the established form.

It is mandatory that all applicants and employees of the previously mentioned fields must visit:

  • neurologist;
  • psychiatrist;
  • narcologist;
  • surgeon;
  • otolaryngologist;
  • ophthalmologist;
  • therapist.

Women will additionally have to go to a gynecologist. If a girl is over 40 years old, there is a need to visit a mammologist. Otherwise, the form you are studying will not be issued.

This list may expand. Most often, people are asked to see a cardiologist. This is especially true for people of pre-retirement age.

Analyzes

An extract on the health status of the applicant/employee is issued not only after visiting medical specialists. Before this you will have to undergo a series of tests.

Typically the following tests are required:

  • general blood and urine analysis;
  • smears for microflora and cytology;
  • chest x-ray;
  • ECG (desirable);
  • Ultrasound of the mammary glands (women over 40).

Doctors can supplement the proposed list of studies. But all modern applicants and employees will have to undergo these tests without fail.

Important: due to the fact that the results of some studies are valid for only 14-30 days, it is recommended to first get tested and then quickly visit the specialists listed earlier. Otherwise, the commission will be delayed.

Documents for registration

What papers are useful so that a person can be issued a certificate 302n? Without taking into account the research results, a citizen must have with him:

  • passport (any other identification document will do);
  • application for passing the commission;
  • Compulsory medical insurance/VHI policy;
  • SNILS.

This package of papers will be useful during a visit to a public clinic. For private centers, it is enough to have an ID card and money with you.

Price

How much does certificate 302n cost? The form of the corresponding document can be issued either free of charge or for a fee. It is problematic to name the exact cost of a health statement.

The thing is that in state clinics, as a rule, no money is charged for a medical examination for work or university. In some cases, there is a symbolic fee, which is about 1.5 thousand rubles.

In private clinics, the cost of the commission varies. On average, the cost of producing an extract about a patient’s health status is 2-5 thousand rubles. More accurate information will have to be clarified at the selected medical center.

Validity

Some people are wondering how long certificate 302n will be valid. This is a normal question, because a medical commission often takes a lot of time and effort.

According to established standards, form 302n is valid for 2 years from the date of issue. At the same time, it is important to take into account that at work, when employed in harmful or dangerous production, they take place at intervals of 6-12 months. This is normal. And it does not mean that Form 302n needs to be updated annually. It is enough to renew the validity of the medical book.

Sample certificate 302n contains the most complete information about the patient’s health status. This is an analogue of form 086/у.

As a rule, in the correct paper sample you can see:

  • results of all tests performed;
  • records of examinations by specialists;
  • date of issue of the certificate;
  • name of the authority issuing the document;
  • seal of a medical institution;
  • doctor's signature;
  • decision of the commission regarding the citizen’s health status.

There is no third-party information in the document. Often the paper being studied is given in free form.

Design features

Some people are wondering where it is better to turn for help when passing a medical examination for form 302n. There is no clear answer.

If a citizen goes to a private clinic, he can pass the commission in a few hours. This technique saves a lot of time, but it costs money.

If you go to a public clinic, you can go through a commission of the established form for free. But in this situation, visiting specialists and taking tests will take a lot of time and effort.

As has already been emphasized, this paper is an analogue of form 086/у. Therefore, the extract on a person’s health status that is being studied is often issued on such a form.

By engaging employees under employment contracts, the company administration is responsible for their health. Therefore, it must prevent and minimize the impact of harmful conditions on the health of workers. For this purpose, when hiring, the employer sends employees to undergo medical examinations, and for some categories of workers it is mandatory to conduct periodic medical examinations. All these points are considered by Order 302n dated April 12, 2011 of the Ministry of Health and Social Development, as amended in 2018.

The main legislative act that regulates the procedure for employees of organizations to undergo medical examinations is Order No. 302 approved by the Ministry of Health. Its norms were adopted back in 2011. The provisions of this normative act have been supplemented three times. This happened in 2013, 2015, 2018.

This order establishes not only basic concepts and procedures, but also cases when a medical examination is mandatory for company management.

Changes and additions to the order dated April 12, 2011 No. 302n 2018

Currently, the following changes and additions to the Order of the Ministry of Health can be distinguished:

  • In the new edition, the order provides for a wider list of factors that have a harmful and dangerous effect on the health of the worker, in the presence of which periodic medical examination and other types are mandatory. For example, welding aerosols with manganese-containing and silicon-containing compounds have been added to the factors with chemical effects; to the factors that can have a biological effect, we added a larger number of allergens, infected material, as well as AIDS, hepatitis B, C viruses; The list of physical impact factors has been expanded - ionizing radiation and increased gravitational overloads.
  • The list of doctors by specialization who examine workers during medical examinations has been significantly expanded. Now it includes endocrinologists, dentists, and allergists.
  • For cases where an employee is employed in jobs where there is exposure to certain factors, the list of additional contraindications has been expanded (for example, exposure to electromagnetic fields), just as for certain jobs, for example, in geographically remote areas, when working on machines.
  • A new section has been introduced into the order, which defines substances and compounds that have a common chemical structure and lead to various diseases, and the list of dangerous pesticides has been expanded.

For whom a medical examination under order 302 is mandatory

The order establishes a list of employees who must undergo a medical examination.

This includes workers:

  • Those whose working conditions involve exposure to hazardous and harmful factors. These include chemical, physical, biological. A complete list of these factors is defined in Appendix No. 1 to Order of the Ministry of Health Development 302.
  • Those employed in the types of work listed by law. These include work underground, under water, at height, etc. They are listed in Appendix No. 2 to Order of the Ministry of Health 302.

To assign working conditions the status of harmful or dangerous, it is necessary. Only after an assessment is carried out is the hazard class of the factor and the need for a medical examination determined.

Important! Do not forget about the need to undergo a medical examination in accordance with the Labor Code of the Russian Federation. This regulatory act defines workers who must undergo a medical examination before being allowed to work.

This includes:

  • Employees who have not reached the age of majority (18 years).
  • Those entering a company where workplaces are exposed to hazardous and harmful factors.
  • Those applying for work in organizations of the food industry, catering, trade, working at water utility enterprises, medical and children's institutions.
  • When working on a shift.
  • Employees applying for underground work.
  • When you will have to work in the regions of the Far North, as well as areas equivalent to them.

The procedure for referral for a medical examination

For preliminary

In order for an employee to pass, a referral must be issued for him. This form, together with a document confirming your identity, must be presented at the medical institution. If the employee is not being examined for the first time, then he must have a health passport in his hands, which must also be presented.

The medical institution opens a card for this employee, and if there is no health passport, it issues such a document.

All those specialists whose opinions must be taken into account for the examination according to labor standards must take part in the medical examination.

As the examination progresses, doctors will write down the results of the examination on the card, and will also include the results of laboratory tests. Based on the results of the examination, the result is reflected in the card, after which this document remains in storage at the medical institution.

The employee is given a conclusion in which it is necessary to reflect whether there are any contraindications for working in the desired position. The conclusion is drawn up in two copies, one must be kept in the medical institution, and the second must be transferred to the employer.

Attention! A health passport must be opened for each employee who undergoes a preliminary medical examination or periodic examination at a medical institution. Initially, this form is stored with the employee's card. After the inspection is completed, the data is entered into the passport, and then it is handed over to the employee.

On periodic

This type of medical examination takes place on the basis of lists compiled by the responsible person of the business entity. They must include all workers who are employed in workplaces with harmful or dangerous factors. The list of employees must be compiled at least 2 months before the start date of the medical examination.

One of the innovations was the fact that even during a periodic inspection, a company representative must give the employee a referral. It is issued in a standard manner.

The medical organization with which an agreement has been concluded to conduct a medical examination prepares lists of specialists and establishes the procedure for conducting it. It must submit all the necessary papers to the employer no later than 14 days before the start of the medical examination.

The procedure for examining employees follows the usual procedure and ends with the issuance of a medical report. After this, the organization issues a final inspection report.

The fully completed referral is signed by the person responsible for this with personal information. In the event that a newly arriving employee is sent for a mandatory inspection, the referral must be issued to him against signature. To record this fact, it is necessary to have a special journal or sheet in the company.

Attention! The type of referral is not established by law. Each business entity develops it themselves, taking into account their needs, but using mandatory details.

Responsibility of the employer for allowing an employee to work without a medical examination

The law establishes liability for those employers who allow their employees to begin work without performing the necessary medical examination. This responsibility is established in the Code of Administrative Offenses.

According to this legislative act, the following are liable for violation:

  • For an official - 15-25 thousand rubles;
  • Entrepreneurs – 15-25 thousand rubles;
  • For a company - 110-130 thousand rubles.

The amount of the fine imposed will be determined based on the number of employees allowed to work in this way.

If the health of an employee who has not undergone a medical examination is damaged or his death occurs, then non-compliance with the law will be considered from the perspective of the Criminal Code.

Important! In turn, if an employee refuses to undergo a medical examination, then the Labor Code provides for his removal from work in this case. This measure is introduced after written acquaintance with the employee’s signature.

It will be valid until he provides the company administration with a document confirming his suitability for work. The employee does not retain his salary for the period of such temporary suspension.

Let's first find out why we actually need certificate 302n. Medical certificate 302n is issued if you get a permanent job. To receive it, you need to undergo a medical examination by several specialist doctors. In addition, you still have to have a chest x-ray and undergo some types of tests. Based on the results of the entire medical examination, based on the results of tests and x-rays of the lungs, you will be issued a medical certificate in format 302n.

Another interesting fact is the fact that gave rise to such a strange name for the certificate - 302n. In fact, this name comes from the name of the resolution, which is called 302n. This regulation was introduced in 2012. In general, this order regulates medical examinations for those people who take a job that involves hazardous operating conditions, as well as hazardous substances.

By the way, it’s worth mentioning right away that previously such a certificate was issued without an examination by a psychiatrist or a narcologist, but now the medical report of these specialists is simply necessary, since without them document 302n simply will not be valid.
